Compulsory purchase is where the government, local council or utility company has the legal right to buy or take rights over private property, if it falls within a public or private construction project, e.g. airport expansions, housing developments, sewer, water or gas pipe schemes, and rail or road building projects.

RSL’s Compulsory Purchase and Compensation surveyor’s extensive CPO experience enables them to help their clients through what can be a frustrating and complex process.

Whether the client is a developer or local authority seeking to use Compulsory Purchase procedures, or is a private landowner or occupier on the receiving end of a Compulsory Purchase Order, or who is detrimentally affected by the execution or use of a public or private construction project (utilising Compulsory Purchase procedures), Robertson Simpson Limited are here to help.

RSL’s surveyors possess an in depth knowledge of the Compulsory Purchase and Statutory Compensation statutes and of the case law surrounding them.

When acting for a developer or acquiring authority RSL will:

  • Provide estimates of acquisition costs in advance of acquisition;
  • Negotiate with affected landowners and occupiers prior to the acquiring authority obtaining CPO powers;
  • Appear as an expert witness at Public Inquiry; and
  • Negotiate with owners and occupiers once the CPO is granted.

When acting for owners or occupiers RSL will:

  • Advise on the acquiring authority’s case;
  • Consider and advise the client on possible objections to a CPO and if necessary appear at Public Inquiry to present its client’s case;
  • Present a claim for compensation within the compulsory purchase framework and negotiate with the acquiring authority.

If negotiations fail, RSL will act in the capacity of expert witness before the Lands Tribunal.
